Agreement Terms

This is to be considered a Mechanical Only Survey. It is understood that Marine Diesels, Gasoline engines or Outboard Engines are being surveyed by a qualified marine mechanic to determine the condition of the motor/power head, gears, pumps, cylinder compression (Gasoline Only Engines), exhaust system, lower unit seals and gear lube condition, tilt and trim mechanics, etc. Moore Marine Solutions LLC will not inspect the hull and fiberglass of the vessel and any other system outside of the Engines, Gears, Lower Units or Generators of the vessel.

Acceptance and use of this report by the client acknowledges the client's understanding that the report has been composed of information that is believed to be true after reasonable investigation and inquiry but is not warranted to be so. The information was obtained without drilling, diving, ultrasonics, cleaning or opening up to expose parts or conditions ordinarily concealed. There were no tests for tightness or soundness conducted other than the conditions noted visually.

Acceptance and use of this report acknowledges the client's understanding that no determination of stability or structural strength has been made and no opinion is expressed. Moore Marine Solutions LLC does not accept any responsibility for damage or deterioration not found or discovered during the course of survey, nor for consequential damage, deterioration or loss due to any error or omission.

Payment is required prior to survey day. Payment is due for services rendered, not when the client receives the report. All credit card transactions will be charged a 3.5% convenience fee if used. Accepted payment methods: Venmo, Zelle, Check, Cash, or CC invoice.

Cancellation must take place 48 hours prior to the survey date by phone call, voicemail, email, or text. A cancellation fee of 50% of the survey fee will be required if not properly cancelled 72 hours prior to the survey.

Survey reports will take 2–4 business days to complete after the survey day. Written approval and an expedition fee of $375.00 will be charged for quicker turnaround if Moore Marine Solutions LLC approves and can accommodate this quick turnaround.

In the event that during the survey day something fails, breaks down, delays, does not start up, or anything unforeseen happens that causes the job not to be fully finished, Moore Marine Solutions LLC will charge an additional fee or daily rate to reschedule or to have a second survey day.

The Client hereby agrees to indemnify and hold harmless Moore Marine Solutions LLC, and its employees, agents and subcontractors against all actions, proceedings, claims, demands or liabilities whatsoever or howsoever arising which may be brought against them, and in respect of all costs, loss, damages and expenses (including legal costs and expenses on a full indemnity basis) which Moore Marine Solutions LLC may suffer or incur in the course of the services under these Conditions.

Notwithstanding the above, in the event the Client proves that the loss, damage, delay or expense was caused by the Surveyor, then, save where loss, damage, delay or expense has resulted from Moore Marine Solutions LLC's gross negligence or willful intent, the liability for each incident or series of incidents giving rise to a claim or claims shall never exceed a sum calculated on the basis of two times Moore Marine Solutions LLC's charges.

In the event of litigation, the losing party shall pay the reasonable attorney's fees and costs of the prevailing party. Venue for any action brought under this contract shall be the courts of Broward County, Florida.
